1. GENERAL TERMS<\/p>\n<\/div>\n\n\n\n

1.1 These Terms and Conditions govern the legal relationship between Lillun\u00e8 O\u00dc (hereinafter referred to as the \u201cSeller\u201d) and the customer purchasing goods through the online store www.lillune.ee\n (hereinafter referred to as the \u201cCustomer\u201d).<\/p>\n\n\n\n

1.2 These Terms and Conditions apply to all sales contracts concluded through the online store.<\/p>\n\n\n\n

1.3 In addition to these Terms and Conditions, the legal relationship between the parties is governed by the laws of the Republic of Estonia, including in particular:<\/p>\n\n\n\n

\u2022 Law of Obligations Act (LOA)<\/p>\n\n\n\n

\u2022 Consumer Protection Act<\/p>\n\n\n\n

\u2022 Directive 2011\/83\/EU of the European Parliament and of the Council (Consumer Rights Directive)<\/p>\n\n\n\n

1.4 The Seller reserves the right to amend these Terms and Conditions. Amendments will be published on the website and shall enter into force upon publication.<\/p>\n\n\n\n

\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

2. CONCLUSION AND ENTRY INTO FORCE OF THE SALES CONTRACT<\/p>\n<\/div>\n\n\n\n

2.1\n\nThe Seller sells and the Customer purchases products offered in the online store.<\/p>\n\n\n\n

2.2\n\nThe sales contract is deemed concluded once the amount payable for the order has been received in the Seller\u2019s bank account.<\/p>\n\n\n\n

2.3\n\nBy placing an order and making payment, the Customer confirms that they have read and agree to these Terms and Conditions.<\/p>\n\n\n\n

\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

3. PRICES<\/p>\n<\/div>\n\n\n\n

3.1\n\nAll prices displayed in the online store are in euros and include VAT in accordance with the applicable tax rate in the Republic of Estonia (currently 22%).<\/p>\n\n\n\n

3.2\n\nThe Seller reserves the right to change prices. If the Customer placed the order before the new prices entered into force, the price valid at the time of placing the order shall apply.<\/p>\n\n\n\n

3.3\n\nThe Customer is not entitled to claim compensation for any price difference.<\/p>\n\n\n\n

\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

4. PAYMENT FOR THE ORDER<\/p>\n<\/div>\n\n\n\n

4.1\n\nThe Customer shall pay 100% of the order amount in advance.<\/p>\n\n\n\n

The available payment methods are displayed during checkout (e.g. bank links, card payment). Payments are processed by\u00a0Maksekeskus AS<\/a>. Payment takes place outside the online store in a secure environment \u2014 when paying via bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Maksekeskus AS. The Seller does not have access to the customer\u2019s bank or credit card details. The agreement enters into force once the amount payable has been received in the Online Store\u2019s bank account.<\/p>\n\n\n\n

The owner of the online store is the controller of personal data and transfers the personal data necessary for processing payments to the authorized processor, Maksekeskus AS. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed as soon as possible and the paid amount (including delivery costs) will be refunded without delay, but no later than within 14 days from sending the notice.<\/p>\n\n\n\n

4.3\n\nPerformance of the sales contract begins after payment has been received.<\/p>\n\n\n\n

\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

5. DELIVERY<\/p>\n<\/div>\n\n\n\n

5.1\n\nAfter the contract enters into force, the Seller will prepare the order and hand it over to the logistics partner.<\/p>\n\n\n\n

The delivery period begins from the receipt of payment. The buyer can choose the following delivery methods for receiving the goods: DPD, Smartpost, Omniva, Venipak and Unisend parcel machines, or courier services. Shipping costs are borne by the buyer and the corresponding price information is displayed next to each delivery method.<\/p>\n\n\n\n

Domestic shipments within Estonia generally arrive at the destination specified by the buyer within 2\u20135 working days from the entry into force of the sales agreement. Deliveries outside Estonia take place within 7\u201314 calendar days, depending on the destination country.<\/p>\n\n\n\n

5.3\n\nThe Customer is responsible for the accuracy of the information provided in the order.<\/p>\n\n\n\n

5.4\n\nThe Seller shall not be liable for delivery delays caused by:<\/p>\n\n\n\n

\u2022 Incorrect information provided by the Customer<\/p>\n\n\n\n

\u2022 Force majeure<\/p>\n\n\n\n

\u2022 Actions of the logistics partner beyond the Seller\u2019s control<\/p>\n\n\n\n

5.5\n\nA product damaged during transport will be replaced or compensated if the damage has been documented and reported without delay.<\/p>\n\n\n\n

\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

6. RIGHT OF WITHDRAWAL<\/p>\n<\/div>\n\n\n\n

6.1\n\nPursuant to Section 56(1) of the Law of Obligations Act, the Consumer has the right to withdraw from the contract within 14 days from receiving the goods.<\/p>\n\n\n\n

6.2\n\nReturned goods must be:<\/p>\n\n\n\n

\u2022 unused<\/p>\n\n\n\n

\u2022 undamaged<\/p>\n\n\n\n

\u2022 in original packaging<\/p>\n\n\n\n

6.3\n\nPursuant to Section 53(4) of the Law of Obligations Act, the right of withdrawal does not apply to hygiene and cosmetic products if their packaging has been opened.<\/p>\n\n\n\n

6.4\n\nThe Customer bears the cost of returning the goods unless the product does not correspond to the order or is defective.<\/p>\n\n\n\n

6.5\n\nThe withdrawal notice must be submitted by email within 14 days of receiving the goods.<\/p>\n\n\n\n

6.6\n\nThe Seller shall refund the amount paid by the Customer no later than 14 days from receiving the withdrawal notice but may withhold the refund until the goods have been returned.<\/p>\n\n\n\n

7. SUBMISSION OF CLAIMS<\/p>\n<\/div>\n\n\n\n

7.1\n\nPursuant to Section 218(2) of the Law of Obligations Act, the Consumer has the right to submit claims within two years from receiving the goods.<\/p>\n\n\n\n

7.2\n\nIf a defect appears within the first year after delivery, it is presumed that the defect existed at the time of delivery (Section 218(2\u00b9) of the Law of Obligations Act).<\/p>\n\n\n\n

7.3\n\nThe Customer must notify the Seller of the defect within a reasonable time, but no later than two months after discovering it.<\/p>\n\n\n\n

7.4\n\nThe Seller shall not be liable for:<\/p>\n\n\n\n

\u2022 Damage caused by the Customer<\/p>\n\n\n\n

\u2022 Improper use<\/p>\n\n\n\n

\u2022 Normal wear and tear<\/p>\n\n\n\n

\n\t\t\t
\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

8. LIABILITY AND FORCE MAJEURE<\/p>\n<\/div>\n\n\n\n

8.1\n\nThe Seller and the Customer shall be liable to each other for damages caused in accordance with the laws of the Republic of Estonia.<\/p>\n<\/div>\n\n\n\n

\u2022 Natural disasters<\/p>\n\n\n\n

\u2022 Government restrictions<\/p>\n\n\n\n

\u2022 Supply chain disruptions<\/p>\n\n\n\n

\n\t\t\t
\n\t\t\t\t\t\t\t\t\t\t\t\n\t\t\t\t\t\t\t\t\t\t<\/path><\/svg>\n\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t<\/div>\n\t\t\t\n\n\n

9. PRIVACY<\/p>\n<\/div>\n\n\n\n

9.1\n\nPersonal data is processed in accordance with the Privacy Policy and Regulation (EU) 2016\/679 of the European Parliament and of the Council (GDPR).<\/p>\n\n\n\n

9.2\n\nPersonal data is used solely for fulfilling orders and complying with legal obligations.<\/p>\n\n\n\n

10. DISPUTE RESOLUTION<\/p>\n<\/div>\n\n\n\n

10.1\n\nThe parties shall attempt to resolve disputes through negotiations.<\/p>\n\n\n\n

10.2\n\nIf no agreement is reached, the Consumer has the right to contact:<\/p>\n\n\n\n

\u2022 The Consumer Disputes Committee (Consumer Protection and Technical Regulatory Authority \u2013 TTJA)<\/p>\n\n\n\n
